By using the Identiv website (identiv.com), you give your consent that all personal data that you submit may be processed by Identiv, Inc. in the manner and for the purposes described in the following Privacy Policy. Because we respect your right to privacy, we have developed this Privacy Policy to inform you about the ways in which Identiv collects, uses and discloses information it obtains through your use of our Services.

Definitions

The website at identiv.com is owned and operated by Identiv, Inc. The terms “Identiv”, “we”, “us”, “our”, and “ours” when used in this Privacy Policy mean Identiv, Inc., which includes all its subsidiaries, affiliates, and related companies.

The terms “you”, “your”, and “yours” when used in this Privacy Policy mean and refer to any human person who is a user of this website.

The term “PII” refers to any personally identifiable information about you, such as your name, company affiliation (if any), email address, telephone number, fax number, mailing address, and information about the internet access device that you use to access our Services. 

The term “Services” means and refers to all of the products and services that Identiv provides to its customers, users, and visitors to the identiv.com website.

The terms “site” and “website” refer to the Identiv website at identiv.com.  

Collection of Personally Identifiable Information (PII)

We do not collect any PII from a visitor to our site unless that visitor explicitly and intentionally provides PII to us. If you are simply browsing our site, we do not gather any PII about you. We use links throughout our site to provide you with the opportunity to contact us via email to ask questions, request information and materials, or provide comments and suggestions. You may also be offered the opportunity to have one of our representatives contact you personally to provide you with additional information about our products or services. To do so, we may request personal information from you — such as your name, company affiliation (if any), address, email address, telephone number, fax number, and mailing address — to help us satisfy your request.

Notwithstanding the statements above, if you enable the geolocation settings in your mobile device to send location information about you, we will automatically collect that information, but we will never share your location data with third parties for marketing or supporting ads. Also, when you use our Services, we will automatically collect certain information that your browser on your Internet Access Device sends to us (such as your browser type and version), your device’s Internet Protocol address, your location (if geolocation is enabled), your operating system, and statistics about how you use our Services.    

Statistical Information About Your Visit

When you visit our site, our computers may automatically collect statistics about your visit. This information does not identify you personally, but rather about a visit to our site. We may monitor statistics, such as how many people visit our site, our users’ IP addresses, which pages people visit, from which domains our visitors come, and which browsers people use. We use statistics about your visit for aggregation purposes only. As part of these efforts, we strip PII of its sensitive and individual data and make it anonymous so that it is no longer PII (“non-PII”), and then we aggregate that non-PII and subject it to analysis in its aggregate form.  Quantitative analyses of aggregated non-PII data can tell us how often Users access a particular feature of the Services, and we can use that knowledge to make the Services more efficient, and to make them as useful to as many users as possible.  We also use anonymous non-PII, some of which is obtained via pixels or web beacons, for internal research and development purposes to improve our products, and to improve and test the features and functions of our website and our Services. 

Use of Cookies

Many commercial websites use a standard technology called a “cookie” to collect information about how people use the site. A cookie is a small string of text that a website can send to a user’s browser. A cookie cannot retrieve any other data from your hard drive, pass on computer viruses, or capture your email address. Currently, the Identiv website uses cookies in conjunction with the presentation of an End User License Agreement that must be accepted by the user before downloading software drivers from the support page of the website. This cookie will be erased from the user’s computer once the user has closed the browser.

Use of Your PII

We process your PII only for specific and limited purposes. We ask only for data that is adequate, relevant, and not excessive for those purposes. When we ask you for PII, we tell you the purposes for which we will process that data. Some of these purposes include the following:

We generally respond to any email questions, requests for product, service or investment information, and other inquiries that we receive.

We may also retain this correspondence to improve our products, services, and website, and for other disclosed purposes. We may retain contact information so that we can send individuals updates or other information about our services and products.

We may contact you occasionally to inform you of new services we will be providing, or special offers, events, or articles we think will be of interest to you.

At your explicit request, we will add your name to our database to receive investment-related news about Identiv.

We may use your PII internally to help us improve our products and services and to help resolve any problems.

Disclosure of Your PII

We currently do not sell or distribute your PII with or to third parties, except under limited circumstances, including those described below. In the future, we may sell or distribute your PII with or to third parties under other circumstances.

In the case of email requests for technical support, we sometimes forward the sender’s email request, which may contain your PII, to the relevant contact at one of three companies that now distribute and support certain products for which we continue to receive support requests.

In the case of email requests for sales contact or product sales information, we sometimes forward the sender’s email request, which may contain your PII, to one of our distributors, or for inquiries for products not sold by us, to business partners whom we know have similar products to those being requested.

We may share or transfer the information in our databases, which may contain your PII, to comply with a legal requirement, to enforce legal rights, to protect your vital interests, to protect the security or integrity of our databases or this website, to take precautions against legal liability, or in the event of a corporate sale, merger, reorganization, dissolution, or similar event.

Your Rights to Control Our Use of Your PII

You have the right to control the use of your PII in the ways enumerated below.  We have delineated these rights because we have users who reside in California, and therefore our Privacy Policy complies with the California Online Privacy Protection Act (“CalOPPA”) and with the California Consumer Privacy Act (“CCPA”). 

a.  The Right to Know

b. The Right to be Notified

You have the right to change, edit, or delete (see below) any of the PII we have collected from you during your use of our website.  If you register and create a profile, you can add, edit, or update your PII, or delete your registration account profile in whole or in part.

d. The Right to Delete and Be Forgotten

You have the right to request that we delete any PII we have collected from you.  We will comply with any such request that we receive from you, except when we need the PII to complete a transaction that you requested, or when we need to retain your PII to comply with a legal obligation under other applicable laws.

e. The Right to Say No

We do not sell, license, lease, rent, or trade PII, but we nevertheless comply with the CCPA requirement to include a “Do Not Sell My Personal Information” notice on our homepage: clicking on that notice will bring you here to this Policy, where we provide the email address and toll free number above to allow you to communicate to us your desire to opt-out.

f. The Right to Fair and Equal Treatment

In compliance with CCPA’s non-discrimination provisions, we do not distinguish between users based on their choices in regard to exercising their privacy rights. 

g. The Right to Not Be Tracked

You have the right not to be tracked for targeted advertising.  Your right to opt-out of such tracking is protected under CalOPPA.  If you use a popular browser (such as, but not limited to, Safari, Chrome, Internet Explorer, or Firefox) you can set the “Do Not Track” (or DNT) preference setting on your browser to opt-out of online behavioral tracking.  We respond to Do Not Track (DNT) signals, as we are required to do under CalOPPA.

Your Additional Controls over Your PII 

In addition to the rights delineated above, you have control over the use of your PII in the following specific contexts:

a.  General Communications

If you do not want to receive general communications from us, which will include marketing materials from us and from our partners, you may opt-out of receiving such communications, and we ask that you please indicate your preferences on your account settings.  Please remember that even if you opt out of receiving general communications from us, we may still send you important information related to your account or to the Services. 

b.  Profile Changes

Under CalOPPA, you have the right to change, edit, or delete any of the PII we have collected from you during your use of our Services.  Accordingly, you can add, edit, or update your personal information, or delete your registration account profile in whole or in part.   Please know that when you update or delete your information, we may maintain a copy of the unrevised information in our records, but never in a manner that would identify you personally.  Also, please keep in mind that if you delete your registration account profile in whole or in part, the Services will no longer be available to you unless and until you re-register.

c.  Location Information

You can prevent us from collecting location information from your Internet Access Device by changing the settings on your internet access device.

d.  Cookies

e.  “Do Not Sell My Personal Information

 We do not sell PII. However, we may partner with online service providers who may use technology that uses PII for interest-based advertising. You can opt out of receiving ads that are personalized by sending us an email with the subject line “Opt-Out” to privacy@identiv.com or call us at 1-888-809-8880.  The opt out will place a cookie on your computer that is unique to the browser you use to opt out.  Accordingly, if you change browsers or delete the cookies saved by your browser, you will need to opt out again.

f.  Marketing and California’s Shine the Light Law

Under California Civil Code Sections 1798.83-1798.84, California residents are entitled to ask us for a notice which identifies the categories of PII that we share with any third parties for marketing purposes, and which provides contact information for such affiliates and/or third parties. If you are a California resident and would like a copy of this notice, please submit a written request to privacy@identiv.com.

PII and Children

a.  COPPA

The Children’s Online Privacy Protection Act (“COPPA”) requires online service providers to obtain parental consent before they knowingly collect PII from children who are under 13 years of age.  We do not knowingly collect or solicit PII from children under 13.  If you are a child under 13, please do not attempt to send any personal information about yourself to us through our Services.  If we learn that we have collected PII from a child under age 13 without parental consent, we will delete that information as quickly as possible as may be required by COPPA and other laws.  If you believe that a child under 13 may have provided us personal information without parental consent, please contact us at privacy@identiv.com or call us at + 1 888.809.8880.

b.  California Privacy Rights for Minor Users

(California Business and Professions Code Section 22581)  California Business and Professions Code section 22581 allow California residents under the age of 18 who are registered users of online sites, services or applications to request and obtain removal of content or information they have publicly posted. We strive to maintain the reliability, accuracy, completeness, and currency of PII in our databases and to protect the privacy and security of our databases. Although we cannot guarantee against any loss, misuse, unauthorized disclosure, alteration, or destruction of data, we try to prevent such unfortunate occurrences.

This Privacy Policy applies only to the Identiv website and Services provided through the website, but to no other Identiv URLs through or from which you have reached this website. This website contains hyperlinks to websites that are not operated by Identiv. These hyperlinks are provided for your reference and convenience only and do not imply any endorsement of the activities of these third-party websites or any association with their operators. We do not control these websites and are not responsible for their data or privacy practices. Governing Law

This Privacy Policy forms part of our website Terms of Use and as such shall be governed by and construed in accordance with the laws of the State of California, U.S.A. You agree to submit any dispute arising out of your use of this website to the exclusive jurisdiction of the courts of Orange County, California.

Users Who Reside in Jurisdictions Other than the United States

This Privacy Policy complies with the core provisions of the European Union’s General Data Protection Regulation, Canada’s Personal Information Protection and Electronic Documents Act, and the Australian Privacy Act. a.  No Guarantee of Complete Security

 Although we use commercially reasonable efforts consistent with industry standards to keep your PII secure, we cannot guarantee complete security.  You bear the responsibility and obligation to prevent unauthorized access to any account you have with us by selecting and protecting your password and/or other sign-on mechanism appropriately, and by limiting access to your internet access device.  Unauthorized entry or use, hardware or software failure, and other factors beyond our control, may compromise the security of user information at any time.

b.  Privacy Policy Updates

We might make revisions or updates to this Privacy Policy if federal or state privacy laws change.  If we make such an update or revision, we will also update the Effective Date above. Please note that even if you do not read new updates to the Privacy Policy, those updates, once published, will still govern your use of the Services, and you are still responsible for understanding any update.  If you use the Services after any changes to the Privacy Policy have been posted (as indicated by the Effective Date above), that means you agree to all of the changes.
